Jelen Általános Szerződési Feltételek (továbbiakban ÁSZF) azt a szerződéses tartalmat foglalja össze, melyek alapján a Happy Apartments (szálláshely címe: 8638 Balatonlelle, Napsugár u. 25.) továbbiakban: Szolgáltató, elszállásolási szerződést köt az igénybe vevő személyekkel, szerződő felekkel.

A szolgáltatást vásárló személy, aki az ÁSZF-et tudomásul veszi és magára nézve kötelezőnek fogadja el, továbbiakban Vendég.

A szállás foglalása minden esetben írásban, a honlapon keresztül, vagy e-mail-ben történik. E-mailben történő megrendelés esetén a foglalásnak tartalmaznia kell: a szálláshely megnevezését, a megrendelő nevét, az érkezés és távozás dátumát, a vendégek számát. A megrendelés visszaigazolása szintén minden esetben írásban történik. A szálláshely foglalásának elindításával egyetemben kijelentik, hogy az ÁSZF-et és a Házirendet elolvasták, megértették és elfogadták, aláírtan visszaküldik a Szolgáltató részére. A Vendég írásban leadott foglalása és a Szolgáltató általi írásban megküldött visszaigazolás Szerződésnek minősül.

Amennyiben a megrendelést a vendég megbízásából egy harmadik személy (továbbiakban Közvetítő) adja le a szolgáltatónak, az együttműködés feltételeit a szolgáltató és a közvetítő között megkötött szerződés szabályozza. Ebben az esetben a szolgáltató nem köteles vizsgálni, hogy a harmadik személy jogszerűen képviseli-e a vendéget.

A foglalást feltételesen a visszaigazolástól számított 3 napig tartjuk, további visszajelzés hiányában töröljük. A foglaló a szállásdíj 50%-a, melyet előlegként, a visszaigazolás kiküldése után 3 napon belül kérünk átutalni, elküldeni magyar forintban a megjelölt bankszámlára. Amennyiben nem a foglalást leadó személy bankszámlájáról történik az utalás, kérjük a közlemény rovatba feltüntetni a foglalást végző nevét valamint a foglalási számot, az előleg beazonosíthatósága érdekében. Amennyiben a vendég teljesítése határidőig megérkezik a szolgáltató számlájára létrejön a szerződés. A fennmaradó összeget az üdülés megkezdésekor, a szállás átvételét követően kérjük a helyszínen kiegyenlíteni, vagy érkezés előtt utalással.

Előzetes egyeztetés alapján, és a szabad kapacitás lehetősége alapján, a már véglegesített és visszaigazolt foglalás módosítására van lehetőség. A más dátumra történő foglalás áthelyezése, vagy a létszám módosítása esetében, a Vendég, írásban jelzi kérését és a Szolgáltató módosított visszaigazolása után válik érvényessé a szerződés. Időpont módosítás esetén a befizetett előleg csak az adott naptári évben használható fel. Amennyiben a szállást csak a lefoglalt időponttól későbbi napon tudja elfoglalni, illetve korábbi időpontban kívánja elhagyni, abban az esetben is a teljes lefoglalt időszakra vonatkozó szállásdíj fizetendő. Amennyiben a vendégek az eredetileg megadott létszámnál kevesebben jelennek meg, abban az esetben is a foglalást végző az összes lefoglalt apartman árának kifizetésére köteles.

A szállás lemondását kizárólag írásban fogadjuk el a kézhezvételi dátum figyelembe vételével. Az előleg egyenértékű a lemondás díjával. A vendég ingyenesen lemondhatja a foglalást az érkezést megelőző 21. napig. Amennyiben a foglalást az érkezést megelőző 21. napon belül mondja le, az előleget nem áll módunkban visszatéríteni.

Abban az esetben, ha a foglalás az érkezést megelőző napon kerül lemondásra, vagy a vendég lemondás nélkül nem jelenik meg, a szállásdíj 100%-a fizetendő (az előlegen felüli rész kiszámlázásra kerül).

Amennyiben a vendég nem jelenik meg az általa foglalt időszak első napján 20 óráig és nem értesíti a szállásadót akadályoztatásáról, a szállást a szolgáltató jogosult újraértékesíteni a foglalt időszakra.

A szállásdíj tartalmazza a szállás költségét, a víz és áram szolgáltatást, fűtés, végtakarítás, ágynemű, törölköző, parkolás, valamint az ingatlanhoz tartozó pihenőkert, medence, jakuzzi, szauna, valamint igény szerint a bogrács és grillező használatának költségét. A jakuzzi és szauna használata letéti díjas. Az apartmanok teljesen felszereltek az üdülési célú tartózkodáshoz szükséges eszközökkel.

A szállásdíj az idegenforgalmi adót nem tartalmazza. (Az idegenforgalmi adófizetési kötelezettség csak a 18 éven felüli vendégeket terheli.) A szállásdíj nem tartalmaz étkezést.

A szállás az üdülés megkezdésének napján 14:00 órától foglalható el, és azt a távozás napján 10:00 óráig kell elhagyni, tiszta és rendezett, eredeti állapotban. Távozáskor történik a kulcsok visszaadása a Szolgáltató számára. Az Apartmant a Szolgáltató ellenőrizheti, és az esetleges Vendég által okozott kár/károk esetén, az ebből fakadó költségeket a Vendég az elutazása előtt a helyszínen köteles megtéríteni.

A Vendég a szálláshelyre érkezéskor a hatályos jogszabályoknak megfelelően személyazonosságát köteles a szállás elfoglalása előtt igazolni.

Amennyiben kormányrendelet alapján újra vészhelyzetet, vagy karantént rendelnek el, az előleg egy későbbi választott időpontban felhasználható, végső esetben visszautalásra kerül.

Amennyiben az utazást nagyobb háborús események, terrortámadás, sztrájkok, vagy elhárítatlan természeti jelenségek, technikai akadályok befolyásolják, a szolgáltatások ezen okokból történő elmaradásáért, módosulásáért az üdültető felelősséget nem vállal.

SZÉP kártyás utalás esetén kérjük, hogy az utalás megtörténtéről emailben szíveskedjenek csatolni az arról szóló banki igazolást. Utólagos, SZÉP kártyával történő, a teljes összegre vonatkozó fizetési igényüket nem áll módunkban teljesíteni, vendégeink csak a fennmaradó összeget fizethetik ki SZÉP kártyával. A korábban, banki átutalással fizetett előleget visszautalni, vagy készpénzben visszafizetni nem tudjuk.

Ezen általános szerződési feltételek magyarul készültek. Bármely idegen nyelvre történő fordítás esetén a magyar nyelvű változat az irányadó. A fentiekben nem szabályozott kérdésekben a Ptk. és a mindenkor hatályos magyar jogszabályok rendelkezései az irányadóak.

Az Ön személyes adatainak védelme számunkra kiemelt fontosságú. Az azonosításra alkalmas, személyes jellegű adatok begyűjtése és feldolgozása megfelel az érvényben lévő magyar adatvédelmi előírásoknak. Az Ön adatait bizalmasan kezeljük és harmadik fél számára nem továbbítjuk, kivéve a szerződés teljesítéséhez elengedhetetlen esetben (pl. posta, futárszolgálat).

Jelen ÁSZF 2025. február 21-től határozatlan ideig hatályos.

These General Terms and Conditions (hereinafter GTC) summarize the contractual content according to which Happy Apartments (accommodation address: 8638 Balatonlelle, Napsugár u. 25.) hereinafter: Service Provider enters into an accommodation contract with the persons ordering their services, and contracting parties.

The person purchasing the service, who acknowledges the GTC and accepts it as obligatory, is hereinafter referred to as the Guest.

Accommodation is always booked in writing, via the website or by e-mail. In case of booking by e-mail, the reservation request must include: the name of the accommodation, the name, address, telephone number of the person booking the accomodation, the date of arrival and departure, the number of guests. The order is also confirmed in writing in all cases. By initiating the booking of the accommodation, it is stated that the GTC and the policy have been read, understood and accepted, and a signed form will be returned to the Service Provider by the contracting person. A written reservation made by the Guest and a written confirmation sent by the Service Provider shall be deemed to be a Contract.

If the order is handed over to the service provider by a third party (hereinafter Intermediary) on behalf of the guest, the conditions of the cooperation are regulated by the contract concluded between the service provider and the intermediary. In this case, the service provider is not obliged to check whether the third party is legally representing the Guest.

The reservation is conditionally held for 3 days from the date of confirmation, and will be cancelled in the absence of further feedback. The deposit is 50% of the accommodation fee, which we ask you to transfer and send in Hungarian forints to the indicated bank account, within 3 days after sending the signed confirmation. In case the transfer made from the bank account of a third person, other than the one making the booking, please indicate the name of the depositor and the booking number to be able to identify the deposit. In case the amount of deposit arrives by deadline, the contract will be concluded. The remaining amount must be paid on the spot at the start of the stay, upon occupying the accomodation, or by bank transfer before arrival.

By prior arrangement and subject to availability, it is possible to change a booking that has already been finalized and confirmed. In case of booking the reservation to another date or of a change in the total number of guests, the Guest shall indicate his / her request in writing and the contract will become valid after the modified confirmation of the Service Provider. In case of change of date, the paid deposit can only be used in the given calendar year. In case of late arrival, or departure before the end of the booked period, Guests will be charged for the entire booked period. If the number of guests arriving is less than the original booked number of guests, the entire amount will still be charged for all the apartments booked.

Cancellations will only be accepted in writing, based on the date of receipt. The deposit is equivalent to the cancellation fee. Guests may modify or cancel their booking free of charge prior to the 21th day of their original arrival date. In case Guest prefers to cancel the booking within 21 days before arrival, the deposit payment will not be refunded.

In case the booking is cancelled within 24 hours before arrival or in case the Guest does not show up on the day of arrival the total amount of accomodation fee is to be paid (the remaining amount exceeding the deposit will be charged).

In case Guest does not show up by 8 pm on the first day of the booked period, and fails to notify the the Service Provider, the Service Provider is entitled to resell the accommodation for the remaining booked period.

The accommodation fee includes the cost of accommodation, water and electricity usage, heating, final cleaning, bed linen, towels, parking, using the property’s garden, swimming pool, jacuzzi, sauna and the use of outdoor cooking utensils and barbecue on request. Use of the jacuzzi and sauna is subject to a deposit. The apartments are fully equipped for a holiday stay.

The accomodation fee does not include the tourist tax. (Tourist tax is only payable to guests over the age of 18.) Meals are not included in the room rate.

The accommodation can be occupied from 2:00 pm on the day of arrival and must be left by 10:00 am on the day of departure, in a clean and tidy, original condition. Upon departure, the keys should be returned to the Service Provider. The Service Provider has the right to inspect the Apartment, and in case of any damage caused by the Guest, the resulting costs must be reimbursed on the spot before departure.

Upon arrival at the accommodation, the Guest is obliged to prove his / her identity before occupying the accommodation.

If an emergency or quarantine is re-ordered on the basis of a government decree, the advance can be used at a later chosen date, or will be refunded.

The Service Provider is not liable for any failure or modification of services due to major war events, terrorist attacks, strikes, natural disasters or unavoidable technical obstacles.

These General Terms and Conditions have originally been written in Hungarian language. In case of translation into any foreign language, the Hungarian version shall prevail. In matters not regulated above, the Hungarian Civil Code and the provisions of the Hungarian legislation in force at all times shall apply.

The protection of your personal information is highly important to us. The collection and processing of personally identifiable data complies with the applicable Hungarian data protection regulations. Your data will be treated confidentially and will not be passed on to third parties, except in cases strictly necessary for the performance of the contract (eg postal and courier services).

These GTC are valid from 21 February 2025 for an indefinite period.
